		<description><![CDATA[by Ron Bartels Medical Justice &#8211; Health Care Justice &#8211; Health Care Reform Answers to Solving the Health Care Crisis Continue to Evolve. While national politicians like to use the health care crisis as a way to get votes, Texas Lawmakers have stopped talking and started doing.  When the health care crisis is solved, one of two things will happen.  It will either be solved permanently or temporarily in such a way as to need constant political rhetoric to once again obtain votes.  Problems, once solved, cease to be a tool to garner votes.  Lets push for solutions that keep bureaucrats out of the pie.  Consider what Texas has done so well. Texas doctors continue to benefit from the state’s medical liability reform effort.  The board of the Texas Medical Liability Trust in September of 2008 approved an average rate reduction of 4.7 percent for TMLT-insured physicians.  They also approved a 22.5 percent dividend for renewing policyholders. The changes will take effect Jan. 1, 2009. TMLT has successfully reduced insurance premiums for Texas physicians every year since 2003, when Texas lawmakers boldly passed tort reform legislation that capped damage awards against physicians. 		<description><![CDATA[Posted by Ron Bartels McDaniel Announces $11 Million Settlement With Drug Manufacturer Merck Failure to pay rebates &#8211; Medical Justice LITTLE ROCK – Today, Attorney General Dustin McDaniel announced that the Arkansas Medicaid program will receive $11,371,948 as part of two separate global settlements totaling $649 million with Merck &#38; Co., Inc.. The settlements involve 49 states, the District of Columbia and the federal government. Merck is the manufacturer of the drugs Zocor, Vioxx, and Pepcid. The settlement resolves allegations that Merck failed to pay rebates due state Medicaid Programs under the Federal Medicaid Drug Rebate statute. In addition to the monetary recovery, Merck has entered into a Corporate Integrity Agreement with the United States Department of Health and Human Services’ Inspector General. The Corporate Integrity Agreement will include provisions that will ensure that Merck will market, sell and promote its products in accordance with all Federal health care program requirements. 		<description><![CDATA[Posted by Ron Bartels:  MCDANIEL JOINS 28 OTHER ATTORNEYS GENERAL IN SETTLING CONSUMER PROTECTION CLAIMS AGAINST CAREMARK Medical Justice &#8211; Consumer Justice LITTLE ROCK- Today, Attorney General Dustin McDaniel announced that he along with Attorneys General from 28 other states, entered into a settlement of consumer protection claims against Caremark Rx, L.L.C., one of the nation’s largest pharmacy benefits management (PBM) companies. The States allege that Caremark engaged in deceptive business practices by encouraging doctors to switch patients to different brand name prescription drugs and representing that the patients and/or health plans would save money. But doctors were not adequately informed of the effect this switch would have on costs to patients and health plans. Moreover, Caremark did not clearly disclose to their client plans that money earned by Caremark accrued from the drug switching process would be retained by Caremark and not passed directly to the client plan. The complaint further alleges that Caremark restocked and re-shipped previously dispensed drugs that had been returned to Caremark’s mail order pharmacies. As part of the settlement, Caremark is required to significantly change its business practices.
