McDaniel Demands Termination of Payday Lending in Arkansas Financial Justice &#8211; Consumer Justice LITTLE ROCK– Attorney General Dustin McDaniel announced today that he is sending letters to “payday lending” businesses operating under a license in Arkansas, asking them to stop the practice immediately. McDaniel defines “payday” lending as short term loans that charge interest in amounts that vastly exceed the usury limit imposed by the Constitution of the State of Arkansas. Based on the strength of two recent Arkansas Supreme Court opinions, McDaniel is advising payday lenders that charging exorbitant interest rates on these loans violates both the constitutional limit and the Arkansas Deceptive Trade Practices Act, a law enforced by the Attorney General. McDaniel demands that the payday lenders cease their lending practices immediately, void any and all current and past-due obligations of their borrowers, and refrain from any collection activities related to these type loans. A failure to do so will likely result in the filing of a lawsuit by the Attorney General. Attorney General McDaniel Settles Litigation Against American Veterans Coalition LITTLE ROCK- Attorney General Dustin McDaniel announced today that his office entered into a settlement of a consumer protection lawsuit that was filed against American Veterans Coalition. In December of 2007, McDaniel filed suit against the Washington-based group, claiming that it had deceived Arkansas residents during solicitations for donations. McDaniel alleged that less than 1% of the donations raised were actually used to support veterans and no support whatsoever had been given to Arkansas veterans.A consent judgment between the parties, which will be filed in Pulaski County Circuit Court, stipulates that American Veterans Coalition will pay the Attorney General $33,749. This amount represents the total amount of money donated by Arkansas residents. Under the terms of the settlement, these funds will be redirected to an organization in Arkansas that will use the funds to provide assistance to Arkansas veterans. 		<description><![CDATA[It&#8217;s No Mystery, It&#8217;s A Scam LITTLE ROCK – Attorney General Dustin McDaniel issued this consumer alert to warn Arkansans about the resurgence of the &#8220;secret shoppers&#8221; or &#8220;mystery shoppers&#8221; scam. In the last few weeks, the Public Protection Department of the Office of the Attorney General has received an increased number of complaints and inquiries about this scam, which generally costs each victim between $2,000 and $4,000. A “secret shopper” or &#8220;mystery shopper&#8221; is someone who is &#8220;hired&#8221; to evaluate a retail store&#8217;s performance while posing as an ordinary consumer. Con-artists advertise in newspapers or send out solicitations similar to an employment packet, which includes forms for the consumer to fill out, a check usually in the amount of $3,000 &#8211; $4,000, and instructions to cash the check and use the money to make several small purchases at various well-known retail stores, like Wal-Mart. Once the purchases are made, the consumer is asked to evaluate the retailer&#8217;s performance and wire the remaining funds to an agent using Western Union or MoneyGram. 		<description><![CDATA[Bogus Collectors Use Extortion LITTLE ROCK – In such tough economic times, many people are struggling to make ends meet and finding themselves behind on mortgage, credit and bill payments. Unfortunately for these consumers, calls from bill collectors have become an unwelcomed addition to their daily routine. But what happens if you get a phone call from a debt collector for a debt you don&#8217;t owe or don&#8217;t remember incurring? Recently, Arkansas consumers have been the recipients of phone calls from a phony debt collection operation, and today, Attorney General Dustin McDaniel issued this consumer alert to warn Arkansans about this new scam. From the complaints received by the Public Protection Department, investigators know that the scam artist calls the consumer, and informs him that he has an outstanding debt. Using a threatening manner, the caller demands that the consumer wire money immediately or face arrest. Some frightened consumers, especially elderly consumers, may have thought that they had forgotten owing the bill, and in fear of the threatened consequences, sent the money.
