		<description><![CDATA[by Ron Bartels, Ph.D. Liberal Judge Susan Bolton blocked officers, under Arizona SB 1070, from making warrantless arrests of suspected illegal immigrants for crimes that can lead to deportation. American Citizens are arrested every day without warrants. Liberal Judge Susan Bolton also granted illegal immigrants in Arizona special rights they don’t have in any other State including California. In all other States, Federal law says that non-citizens must carry their personal documents on their person. While this is seldom enforced, it is the law. Liberal Judge Susan Bolton blocked the Arizona copy of the Federal law, which required that immigrants carry their immigration papers. In another aspect of her ruling, Liberal Judge Susan Bolton struck down the law, which banned illegal immigrants from soliciting employment in public places. Therefore, illegal immigrants where granted a right that only legal immigrants and citizens have. In effect, Liberal Judge Susan Bolton granted conditional citizenship rights to illegal immigrants. It is time to clean house and require judges to follow the Constitution.]]></description>

		<description><![CDATA[by Ron Bartels Immigration and Nationality Act of 1952 November 3, 2008 -  The Immigration and Nationality Act, or INA, was created in 1952. Before the INA, a variety of statutes governed immigration law but were not organized in one location. The McCarran-Walter bill of 1952, Public Law No. 82-414, collected and codified many existing provisions and reorganized the structure of immigration law. The Act has been amended many times over the years, but is still the basic body of immigration law. The INA is divided into titles, chapters, and sections. Although it stands alone as a body of law, the Act is also contained in the United States Code (U.S.C.). The code is a collection of all the laws of the United States. It is arranged in fifty subject titles by general alphabetic order. Title 8 of the U.S. Code is but one of the fifty titles and deals with &#8220;Aliens and Nationality&#8221;. 		<description><![CDATA[by Ron Bartels Worker&#8217;s Compensation &#8211; Workplace Justice &#8211; Immigration Status Work Place Injuries do not Discriminate Between Legals and Illegals October 31, 2008 -Workers&#8217; compensation laws were created to compensate an employee for injuries sustained while on the job.  One of the most debated issues in the area of worker&#8217;s compensation is whether workers who have entered the country illegally should be granted the same work place protections that legal employees have. Some argue that illegal immigrants should NOT be entitled to workers compensation if injured while working because they are not lawful employees, and should not be here in the first place.  Others argue that illegal immigrants SHOULD be covered by the worker&#8217;s compensation laws so that employers don&#8217;t have more of an incentive to hire illegals as a way to avoid workers compensation liability. The states vary in how they have addressed that question. Most recently, South Carolina ruled in favor of coverage for illegal workers. Curiel v. EMS In Curiel v. 		<description><![CDATA[by Ron Bartels Immigration Justice &#8211; Immigration Law Did The 9th Circuit Court of Appeals Create an Exception? October 31, 2008 -Current immigration law requires deportation of the alien spouse of a U.S. citizen if their marriage does not last past two years.  This law was intended to prevent sham marriages where a non-citizen would marry a U.S. citizen to quickly gain legal residency and then just as quickly get a divorce. Now, the United States Citizenship and Immigration Service, USCIS, argues they are required to deport aliens whose spouse dies within two years of being married. This law has become known as &#8220;the widow&#8217;s penalty&#8221; and has been the subject of numerous lawsuits against the USCIS. The argument revolves around who is an immediate relative of a deceased person. When a non-citizen marries a citizen, the citizen spouse may &#8220;sponsor&#8221; their alien spouse for residency by filing form I-130 &#8220;Petition for Alien Relative.&#8221;  Form I-130 may only be submitted by an &#8220;immediate relative&#8221; such as a spouse, parent or child.  The government is now arguing that at death spouses are no longer &#8220;immediate relatives&#8221; and thus, the petition must be denied.
